Terms of Service

These Terms of Service ("Terms") govern your use of Themr, an AI-powered Shopify theme generator operated by Themr ("Themr", "we", "us", "our"). By creating an account or using the service, you agree to these Terms. If you do not agree, do not use the service.

Beta notice: Themr is currently in beta. The service may be incomplete, subject to breaking changes, and provided without uptime guarantees.

1. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) to use Themr. By using the service, you represent that you meet this requirement. You must provide accurate information when creating your account.

2. Service description

Themr provides an AI-powered wizard that generates Shopify 2.0 theme files (Liquid templates, CSS, and JSON configuration) based on your inputs. Generated themes are provided as downloadable ZIP archives. We use Anthropic's Claude AI to generate theme code on your behalf.

AI-generated output disclaimer: Themes are generated by AI and may contain errors, incomplete implementations, or code that requires adjustment before use in production. We make no guarantee that generated themes will be free from bugs, compatible with all Shopify features, or suitable for any specific business purpose. You are responsible for reviewing, testing, and deploying generated themes.

AI training:Your wizard inputs are sent to Anthropic to generate your theme. Anthropic may use API inputs and outputs to improve their models unless you have opted out under Anthropic's usage policies. Themr does not use your data to train any AI model.

Themr is not affiliated with or endorsed by Shopify Inc.

Affiliate links:Themr participates in the Shopify Affiliate Program. The "Start a Shopify store" links on our delivery pages, in the README inside downloaded themes, and in our emails are affiliate links. If you start a paid Shopify plan after clicking one, Shopify may pay Themr a commission. This does not change what you pay Shopify, and nothing about your theme depends on using those links. Shopify plans, trials and pricing are Shopify's, and are governed by Shopify's own terms.

3. Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at support@themr.ai if you suspect unauthorized access.

We may suspend or terminate your account if we have reason to believe you have violated these Terms or if required by law.

4. Ownership of generated themes

You own the themes you generate through Themr. We do not claim any intellectual property rights in the output. You may use generated themes for any lawful purpose, including commercial Shopify stores and client projects.

You retain ownership of all content you provide as input (store name, product descriptions, etc.). By submitting inputs, you grant us a limited license to process that data solely for the purpose of generating your theme.

Note: AI-generated code may share structural or stylistic similarities with code generated for other users. We do not warrant that generated themes are unique or free from third-party IP claims.

5. Acceptable use

You agree not to:

  • Use the service to generate malicious, illegal, harmful, or deceptive content
  • Attempt to circumvent rate limits, generation limits, or subscription restrictions
  • Use the service to build or operate a competing AI theme generation service
  • Share, resell, or sublicense access to your account
  • Attempt to reverse-engineer, scrape, or extract our AI prompts or generation logic
  • Violate any applicable law or third-party rights while using the service
  • White-label subscribers using client workspaces: input false or unauthorized client information; you represent that you have authorization to use client names and email addresses stored in the system

We reserve the right to suspend access to accounts that violate this section without prior notice.

6. Billing and subscriptions

Plans and prices

Themr is priced per item: the free theme costs nothing, an AI-designed store is a one-time purchase, add-ons are one-time purchases, and the only subscription is the white-label plan for agencies. Prices are shown on the pricing page and may be adjusted under "Price and credit-cost changes" below, including to reflect changes in the third-party AI model and provider costs the service depends on. Credits still exist behind the scenes for legacy subscription plans and for metered actions such as AI rewrites; where an action spends credits, the product says so before you confirm it. Hero clips have a balance of their own, described below.

  • Free theme: up to five complete single-product themes per day. Deterministic and $0 (no AI generation); the daily allowance resets at the start of each day, UTC. No payment required.
  • A store: $29 USD, one time. One AI-designed multi-page store for your account, with up to three builds from your brief. Builds run one at a time and each is generated only when you ask for it; between builds you may tell us what to keep and what to change. Every build is saved to your account, you may keep any or all of them, and unused builds do not expire and are not refundable separately. Editing in the Shopify theme editor and with our layout controls (sections, size, palette, hero type) is free and unlimited; asking the AI to rewrite a section is a separate paid action shown with its price before you confirm. An optional video or animated hero add-on is $15 USD, one time, produces up to three clips from your product photo of which you keep one, and is fulfilled as three clips on your account. Not a subscription. If none of the builds are acceptable, contact support within 7 days of purchase for a refund of the store and any add-on bought with it.
  • White-label — $99 USD/month. For agencies: Themr branding removed from exports, client workspaces, bulk export, up to 5 team member seats, and 20% off stores and add-ons while the subscription is active. Stores are still purchased per item.
  • Builder ($29 USD/month) and Pro ($99 USD/month) are legacy subscription plans no longer offered to new customers. Existing subscribers keep their plan, credits and features unchanged until they cancel.
  • Photos: product photo tools (put a product on a model, change the scene, fix lighting, upscale) are sold per photo, one time, on any account: $1.99 for one, or in packs shown on the pricing page (five for $5, ten for $7, twenty-five for $15). Photos are fulfilled as credits on your account; unused photos do not expire and stack on any monthly allowance a legacy plan provides.
  • Hero clips: short silent motion clips (animation or video) made from a photo are sold per clip, one time, on any account: $3.99 for one, three for $10, ten for $29. One clip is one generated variant; a clip that fails to generate is returned to your balance. Clips are a balance separate from photos and credits, do not expire, and are not refundable once a variant has been generated. Legacy subscription plans may also pay for a clip from their monthly credits at the per-variant credit price shown before you confirm.
  • Credit top-ups: the same packs, bought from the dashboard, for any metered action.

Billing

One-time purchases (a store, add-ons, credit packs) are charged once, at checkout, via Stripe. Subscriptions (white-label, and legacy Builder or Pro) are billed monthly in advance via Stripe, renew automatically on the same date each month, and you authorize us to charge the payment method on file for each renewal period.

Cancellation and refunds

You may cancel your subscription at any time through the billing portal (accessible from your dashboard). Cancellation takes effect at the end of the current billing period — you retain paid access until that date. We do not offer prorated refunds for unused time in a billing period.

Refunds: for a store purchase, if none of the builds are acceptable, contact us at support@themr.ai within 7 days of purchase and we will refund it in full, including any add-on bought with it. For the white-label plan and for legacy Builder or Pro subscriptions, the same 7-day window applies to your first charge. Credit packs that have been partly spent are not refundable.

Allowances and credit limits

The free theme does not use credits. Its daily allowance resets on the first use in each new day and does not roll over. Store builds are counted per purchase and do not expire. Legacy Builder and Pro allowances are added monthly and unused credits roll over while the subscription remains active. On downgrade to free, rollover stops and the free reset rules apply going forward; credits already on the account remain spendable on metered actions.

Failed payments

If a payment fails, Stripe will attempt to retry the charge according to its dunning schedule. If payment cannot be collected, your account will be downgraded to the Free tier at the end of the current billing period.

Price and credit-cost changes

Themr relies on third-party AI providers — including Anthropic (Claude), Google (Gemini / Vertex AI), and KIE.ai (video generation) — to produce your themes, images, and motion. We do not control those providers' costs, model availability, or terms, and they may change over time. As a result, both our subscription prices and the credit cost of individual actions may change. Specifically:

  • Subscription prices(the monthly fee for a paid plan) may change. We will give you at least 30 days' notice by email before a subscription price increase takes effect. Continued use of the paid tier after the effective date constitutes acceptance of the new price; if you do not agree, you may cancel before it takes effect.
  • Credit costs per action (how many credits a given action consumes — for example a full theme, a hero motion preview, or an image enhancement) may also change, including to reflect changes in the underlying AI model and provider costs above, the introduction of new or upgraded models, or new features. The current credit cost for each action is shown on the pricing page, and, where applicable, in the product before you confirm an action that spends credits.
  • No retroactive charges. Price and credit-cost changes apply only going forward. They do not re-charge you for actions already completed, and they do not reduce, revalue, or expire credits already in your balance. A change to what an action costs affects only actions taken on or after its effective date.
  • No cash value. Credits are a prepaid license to use the service and have no monetary value. They are not redeemable for cash except where required by law or under the refund terms above.

7. White-label plan: client and team data

White-label subscribers (and legacy Pro subscribers) may create client workspaces that store client names, email addresses, and notes. You are the data controller for this information. You represent and warrant that:

  • You have a lawful basis under applicable privacy law (e.g., contractual necessity or consent) to store your clients' information in Themr
  • You will inform your clients that their name and email address are stored in a third-party SaaS tool for project management purposes
  • You will respond to any data subject requests from your clients regarding data held in Themr, and may contact us to assist

White-label subscribers may invite up to 5 team members. You are responsible for the actions of team members who access your account. You may remove team members at any time from the team settings page.

8. Termination

You may delete your account at any time by contacting us at support@themr.ai. Deleting your account cancels your subscription and permanently deletes your stored themes, client workspaces, and team memberships. Downloaded themes remain yours.

We may terminate or suspend your account without notice for violation of these Terms, fraudulent activity, or for any reason at our sole discretion during the beta period. We will provide at least 30 days' notice for non-violation terminations once the service exits beta.

9. Disclaimer of warranties

In plain terms: we provide the service as-is. AI generates the themes — we can't guarantee they'll be perfect, bug-free, or compatible with your specific Shopify setup.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT:

  • Generated themes will be error-free, functional, or suitable for your specific use case
  • Generated themes will be compatible with any specific version of Shopify or any Shopify apps
  • The service will be available without interruption, particularly during the beta period
  • AI-generated output will meet any particular quality standard

10. Limitation of liability

In plain terms: if something goes wrong, our financial exposure to you is capped at what you've paid us in the last 12 months (or $50, whichever is more).

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THEMR OR ITS OFFICERS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST REVENUE, LOST PROFITS, LOST DATA, OR LOSS OF GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE OR GENERATED THEMES.

OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE TOTAL FEES YOU PAID TO US IN THE 12 MONTHS IMMEDIATELY PRECEDING THE CLAIM, OR (B) $50 USD.

Some jurisdictions do not allow limitation of certain implied warranties or exclusion of certain damages, so the above limitations may not apply to you in full.

11. Indemnification

You agree to indemnify and hold Themr harmless from any claims, damages, or expenses (including reasonable legal fees) arising from: (a) your use of the service; (b) content you provide as input; (c) themes you deploy to production; (d) your violation of these Terms or any applicable law; or (e) as an Pro subscriber, any data protection claim arising from client or team member data you store in the service.

12. Governing law

These Terms are governed by the laws of the State of Washington, without regard to conflict of law principles. Any disputes shall be resolved in the state or federal courts located in Washington State.

13. General

  • Entire agreement: These Terms and our Privacy Policy constitute the entire agreement between you and Themr regarding the service.
  • Severability: If any provision of these Terms is found unenforceable, the remaining provisions remain in full force.
  • No waiver: Our failure to enforce any right does not constitute a waiver of that right.
  • Assignment: You may not assign your rights under these Terms. We may assign our rights and obligations without restriction.
  • Changes:We may update these Terms as the service evolves. We will update the "Last updated" date and notify you by email for material changes. Continued use after the effective date constitutes acceptance.
